Some members may have heard about proposed legislation amending PREDFDA (S908/A2480) and claims that it will impact the court’s decision regarding mandatory membership. It will not. The proposed legislation, even if passed, provides an exception for those communities whose assessment rights are “otherwise provided by law”. As Judge Minkowitz relied on existing law in confirming LPPOA’s right to assess, and did not rely at all on PREDFDA, this new legislation will have no affect on the rights established under the court’s judgment.
