Lake Parsippany Property Owners Association Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the LPPOA website, mobile application, and any related services provided by the HOA (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.  

2. Eligibility

The Services are intended for use by Property Owners of the LPPOA community and authorized representatives of the LPPOA.  Resident Non-Property Owners and Non-Residents may elect to become members of the LPPOA and in doing so agree to be bound by these Terms.

3. Account Registration

• You may be required to create an account to access certain features of the Services.
• You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.  
• You agree to notify the HOA immediately of any unauthorized use of your account.  

4. Use of Services

• You agree to use the Services only for lawful purposes and in accordance with these Terms.
• You are prohibited from:
  • Using the Services to transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable material.  
  • Interfering with or disrupting the integrity or performance of the Services.
  • Impersonating any person or entity, or falsely claiming an affiliation with any person or entity.
  • Using any automated means, such as scripts, robots, or spiders, to access or interact with the Services.
  • Collecting or harvesting any personally identifiable information, including account names, from the Services.  

5. Intellectual Property

The Services and all content included therein, such as text, graphics, logos, images, and software, are the property of [HOA Name] or its licensors and are protected by copyright, trademark, and other intellectual property laws.

6. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranty of any kind, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You agree to indemnify and hold harmless LPPOA and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Services.  

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey.  

10. Changes to Terms

LPPOA reserves the right to modify these Terms at any time. Any changes to these Terms will be effective upon posting on the Services.

Liability

The acceptance of this agreement is with the understanding that the use of the lake, services, equipment and facilities of the LPPOA is at the user’s risk. User does hereby release and discharge the LPPOA, its agents, officers and employees, from any and all claims, demands or actions arising out of the use or intended use of the lake, facilities, services or equipment, including without limitation, any claim for personal injuries, resulting from or arising out of the negligence of the LPPOA, its agents, officers or employees. I understand that by signing this application that I will abide by the LPPOA Bylaws and Rules and Regulations. and agree to follow them under penalty of loss of privileges. THERE ARE NO REFUNDS ON ANY FEES.
